Empty Guts – Terms of Service

1. Agreement to Terms

By booking a service with Empty Guts LLC (“Company,” “we,” “us,” or “our”), you (“Client,” “you,” or “your”) expressly agree to be legally bound by these Terms of Service. This agreement is deemed accepted and enforceable upon verbal, written, or digital confirmation of your service booking.

If you do not agree to these Terms, you must not book or accept services from Empty Guts.

2. Service Overview

Empty Guts provides residential and commercial gutter cleaning, leaf and debris removal, ice dam removal, and seasonal exterior maintenance services.

  • All estimates are based on the information provided by the Client at the time of booking.

  • Final pricing may be adjusted if the actual scope of work materially differs from the Client’s description (e.g., excessive debris, unsafe roofline conditions, concealed structural issues, or other hazards).

  • The Client acknowledges that service outcomes depend on environmental conditions and property factors outside the Company’s control.

3. Market Context & Competitive Practices

The Minnesota market—including the Twin Cities, Duluth, and Rochester regions—is served by multiple gutter and exterior maintenance providers. Competitors often operate with broad scheduling windows and restrictive refund/cancellation policies.

Empty Guts distinguishes itself by:

  • Maintaining clear and client-centered policies balancing fairness and operational efficiency.

  • Offering rapid response scheduling for urgent needs such as storm cleanup and ice dam removal.

  • Delivering insured, professional-grade results in compliance with OSHA safety standards.

  • Ensuring transparent pricing and terms, eliminating hidden costs or ambiguous billing practices.

4. Booking & Scheduling

  • Appointments are secured on a first-come, first-served basis.

  • Clients will be provided with an estimated arrival window at the time of booking.

  • Emergency or storm-related calls may receive priority over non-emergency requests.

  • Clients will receive confirmation and reminder notifications ahead of scheduled service.

5. Cancellation & Rescheduling Policy

5.1 Client Cancellations

  • More than 24 hours’ notice: No fee; deposits, if collected, are refundable or transferable.

  • Less than 24 hours’ notice: Client is responsible for a cancellation fee equal to 25% of the quoted service price. This represents a genuine pre-estimate of lost opportunity and administrative costs.

5.2 Company Cancellations

  • Empty Guts reserves the right to reschedule or cancel due to weather, safety, or operational issues (e.g., equipment failure).

  • If Empty Guts cancels a non-weather-related service with less than 12 hours’ notice, the Client shall receive either:

    • A full reimbursement of any payments made, or

    • A rescheduled appointment within 48 hours at a 15% discount.

6. Weather Policy

6.1 Weather Restrictions

Services may be delayed, interrupted, or rescheduled due to:

  • Lightning or severe thunderstorms

  • High winds creating ladder or roof hazards

  • Heavy rainfall, snow, or ice accumulation

  • Any other condition deemed unsafe by the service technician

6.2 Rescheduling & Refunds

  • If service is postponed due to weather, the Company will reschedule within 72 hours of the original appointment.

  • Rescheduled work may include weekend scheduling to meet this timeframe.

  • If the Company cannot complete service within 72 hours, a full refund will be issued.

  • No refunds will be issued for weather delays if the Company reschedules and performs service within the 72-hour window.

7. Payment Terms

  • Accepted Methods: Cash and Credit/Debit cards (Visa, MasterCard, Discover, American Express).

  • Not Accepted: Checks.

  • A la carte services: Full payment is due upon arrival and prior to commencement of work.

  • Subscription services: Full payment is required at time of booking due to high seasonal demand.

  • Failure to remit payment may result in suspension of services and possible legal collection action, including recovery of attorney’s fees and interest as allowed by Minnesota law.

8. Liability & Property Damage

  • Empty Guts is fully licensed and insured.

  • Clients are required to secure or remove any fragile items (patio furniture, décor, potted plants, etc.) prior to service.

  • The Company will not be responsible for damage to unsecured or fragile property left in the work area.

  • Limitation of Liability: Empty Guts’ liability is strictly limited to direct damages caused solely by the Company’s proven negligence. The Company shall not be liable for indirect, incidental, consequential, or punitive damages, including but not limited to water intrusion from pre-existing gutter failure, landscaping impact from ladder placement, or damage caused by defective roofing/gutter materials.

9. Access & Client Responsibilities

  • Clients must provide safe and clear access to all work areas.

  • Gates must be unlocked, pets secured, and obstructions removed prior to service.

  • If our crew cannot access required areas, this shall be deemed a late cancellation and may result in a 25% service fee.

10. Media & Marketing Use

  • The Company may capture before-and-after photos or videos of completed services for documentation and marketing purposes.

  • Such content may be used for training, advertising, or promotional purposes unless the Client provides written notice opting out prior to service.

11. Dispute Resolution

  • These Terms are governed by the laws of the State of Minnesota.

  • Any disputes shall first be attempted to be resolved through good-faith negotiation.

  • If unresolved, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA) in Dakota County, Minnesota.

  • Each party shall bear its own legal fees, except where otherwise required by law.

12. Changes to Terms

  • Empty Guts reserves the right to amend these Terms at any time.

  • The Terms in effect at the time of booking shall govern that service.
